Parental Waiver and Release Form.

By purchasing services offered by Bloom Nature Play, you agree to the following terms and conditions. If you do not agree, please discontinue using our site or proceeding with purchases and/or bookings.

Services:

Bloom Nature Play operates in 40-minute intervals and provides child-led play with age-appropriate sensory stimulation. The program is designed by a qualified educator. Term commitment is required to join the program.

The program is designed for children aged 6+ months to 6 years old. Sessions may be segmented into recommended groups.

If you are unable to attend or are running late and we do not hear from you we may contact your next of kin & follow up for your safety.

Late arrival to the Bloom Nature Play sessions is still considered attendance.

Other Information:

Our services include a range of play-based learning experiences, including but not limited to:

• Food-based products

• Coloured dyes

• Small pieces and loose parts

• Breakables such as metal, ceramics, pottery, etc.

• Paints

• Playdough

• Natural and artificial elements

Conditions of Entry:

We are not responsible for your personal belongings or items. We do not provide secure places for storage, so it is recommended that you leave anything valuable at home.

Personal Safety:

When entering our premises, you acknowledge that your children are your responsibility at all times. Therefore, you are personally responsible for any injury or illness resulting from our products and/or services.

We cannot guarantee an allergy-free environment and have no control over food products brought onto our premises. If you or your child has allergies, please contact us before booking.

Price and Payment:

Enrolling your child/children in the program signifies your consent to receive an invoice and accept legal liability for all associated fees and charges. You are entering into a legal contract with us under Common Law.

Change of Mind:

In accordance with Bureau of Consumer Protection, we are not required to give a refund or replacement if you change your mind about the service. You are still liable for all outstanding fees.

However, in extenuating circumstances, refunds or other forms of compensation may be considered at the discretion of the owners of Bloom Nature Play.

Unpaid/Outstanding Payment:

Failure to attend class for a period of 2 weeks (14 days) without any excuse will result in the cancellation of your place, and your position may be given to the next person. All funds paid for the Bloom Nature Play sessions will be retained as an agreement upon signing up.

Failure to make payment:

Failure to make payment for an invoice within the specified time constitutes a breach of contract. We will take the following measures to collect outstanding debts:

• Resend reminders for outstanding amounts

• Send a formal request for payment

• Issue a Letter of Demand to the provided email address

• Engage a debt collector service

• File a debt dispute with the ____________________________.

Class Absence/Makeup Session:

If you are unable to attend a session, please inform us of your absence via email (bloomnatureplay@gmail.com) or phone (_________________).

Due to limited capacity, we do not offer any makeup sessions for nonattendance.

Delivery:

We strive to deliver our services according to the specified timetable and schedules. In the event that our services cannot take place, we will make reasonable efforts to notify you promptly. Please refer to the Cancellation section for further information.

Cancellation:

We reserve the right to cancel any service without refund or compensation in cases of abnormal weather conditions.

In the event of cancellation due to illness, injury or other unforeseen circumstances, you will be advised as soon as possible, and appropriate options made available to remedy the loss incurred by you.

Personal Information:

Personal Information will be collected in accordance with our Privacy Policy.

Limitation of Liability:

Except in circumstances where liability cannot be excluded by law, we (including employees and contractors) exclude all liability for any personal injury, loss or damage (including but not limited to loss of opportunity, loss of reputation or goodwill, loss of privacy or loss or corruption of information or data); whether direct, indirect, special or consequential, arising in any from the delivery of our services and / or product. This includes but is not limited to any theft, unauthorised access or third party interference.

This limitation of liability applies, even in circumstances where Bloom Nature play has been expressly advised of potential loss.
